You can withdraw an existing 485 application once you get Receipt No. Just write a letter to USCIS asking them to withdraw your 485 application stating the reason for withdrawl.
Sorry for the layman's question, but is there an established process for revoking an AOS application? Thanks for your input!

Let us talk about the "skills" introduced by H1/L1/offshore companies
a) One guy takes the phone interview for 15 other guys with "skills" they preted to have
b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

I am saying Recapture will only help EB2 and not EB3. Bcoz all the recaptured numbers will be used by EB2 first. So EB2 dates will move forward and then people with PD in 2007 and 2008 in EB2 will use up captured numbers and EB3 will still be waiting to get any leftovers.
I am not saying you are wrong but we need numbers to say one way or another. Like I said, the pending EB2-I using the most generous distribution is half of the recapture numbers. There is fresh inflow from new H1B and such but it seems unreal to me that EB2 will not become current with the recapture.
I also agree that it would be better if the recapture numbers are divided, equally or in some manner, among the categories.
Right now, it seems that even if USCIS gives EB1+EB2 ROW numbers to EB3 ROW, the unused EB3 ROW numbers would go back to EB1-C/I--> EB2 -C/I --> EB3 C/I.

If the DOS has common sense they would be better off to retrogess for august, I am pretty sure they will be aware of the class action law suit thats gonna come upon them if they try to revise the july bulletin

If a person has filed an I485 and has a valid H1 visa stamp in his/hers passport, no AP is needed when traveling as h1 is a "dual intent" visa. This applies to H1 and L1 visas. When leaving this country when I485 is pending, the I485 will not be deemed as abondomed because one travels on a "dual intent" visa. IF one, however, had filed an I485 while being on a diffrent type of a visa, like F1, or B2, one MUST obtaint AP before leaving. Other wise the person will NOT be able to re-enter the country even if one has a valid F1 or B2 visa and the I485 will be deemed abandomed. This is because by filing the I485, he/she has shown an immigrant intent, and both F1 and B2 don't allow for such intent.
So many people don't realize that a H1 or L1 are very POWERFUL visas.
I am not an attorney so do not take my answers for granted.

A simple calc to find out how much EB3-EB2 porting going on as of today:
If you look at Demand data released last month by DOS, It lists
Prior to January 1, 2007 , EB2- I pending : 13,200
In my opinion Demand data includes EB3- EB2 porting as well since Demand data reflects overall demand for one category.
Now if you look at inventory data released on Jan 5 ,2011 ,
EB2 India Pending Prior to Jan1st 2007 : 13,516
But if you exclude all the data prior to May = 13,516 - 1,110 - 103 - 133 - 74-108 = ~ 12K
EB2 I demand from the inventory btwn May - Dec 06 = 12K
But Demand data says EB2-I demand is 13,200
Diff : 13,200 - 12K = 1200 ( This number has to be porting)
We know EB2 - I dates have not moved since Oct ,2010 .
So India regular quota for the last six months : 2800/2 = 1400 .
Since dates have not moved, I am assuming 1400 should also be considered towards porting.
so my conclusion is so far 1200 + 1400 = 2600 porting already took place. (though only 1400 really got GC)

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. Hi All, I had a quick question.
My I-485 got approved earlier this week from NSC and I received the approval/welcome letter by USPS.
My online status is at post-decision activity and not at CPO.
Though my welcome notice says that I should receive the card in 3 weeks, I am wondering if I need to be at CPO status before that happens....also I read somewhere they may require another FP before CPO (that was talking more abt transfer cases, but mine has always been at NSC).....but nowhere in my approval notice does it ask for an FP.
I was wondering if I should just sit tight and wait for the physical card or try to find out more information.

Note: the Goldman manager is not screwing us - we are indirectly screwing ourselves by bidding up - aka UAW of GM). Since the threshold for outsourcing is quite a bit lower in a recession - I am suggesting that we don't pick this fight right now and wait for a little while.

I've sent 7001 form to ombudsman and wondering how many days it will take to get a response from them. Can you tell us how long it took for you to get response and how did they contact you? Also after sending 7001 did you follow up by calling or mailing ombudsman?

i dont think you will see a spike for jul/aug 2007 because thousands of apps got filed then, but this report is based off of the PD, not the date the 485 was applied.

Two of my colleagues on Nov 04 and Dec 04 didn't cleared out till.
I don't think so they are on IV, but they will use 6 cards (1+1 in one case and 1+3 in another case)
Since 2004 EB2 is cleared, I am seeing less number of posts being made on IV.Yay I became a senior member, will that mean I will get a green card?

My new theory is the DOS was influenced by politicians who are attorneys (I beleive that there 50% of lawmakers) and it released a huge Visa Numbers. The politicians have strong connections to law firms. The USCIS doesn't want to do it, because it doesn't have 'resources', 'money', 'manpower. So, they are on a near strike mode, not attending routine works like sending receipts., etc in a timely fashion.

Many issues are being swept under the carpet. I had written a few times earlier. The backlog and GC issues are not truly a numbers game. It is the neo-con regime and the republican culture that had engulfed Washington, its consequences, that had made things miserable for us; we, the legal immigrants.
4/5ths of the illegal immigrants have been here by the time of Clinton's second term. It was a non-issue then. You should understand why is it an issue now? Why can't it the legal and illegal immigration be addressed and solved. In a democracy, things like this can be solved administratively, legislatively and judicially. Adminstratively, we we hit below the belt, in backlogs, in delays, in sudden rule changes (no concurrent filings of PD is not current). Legislatively, they are stalling and falling apart. What is left for the immigrants?

Why should you know? Why should you understand? It is in your own interests that you understand things wisely. Failure to know what is happening on the ground, what is happening around us is a sure shot for personal failure.

guys, i am now in UK and it's night time but trying to call as many as possible.

can someone PLEASE start a email campaign (Yes, a chain letter) to at least the DESI community.
