Agree on 1 and 2. But it is (c) (9) FILED I-485 for #3. I applied recently with no problem. Include a copy I-485 receipt.

Appreciate your prompt response Raysaikat. If I get the J1 waiver from Australia, can I file directly under the EB2-NIW without changing to H1B.
After completing my MS (Molecular Biotech) and PhD (Veterinary Science) in Australia, I am currently working on a J1 visa for the last 3 years in US university. but an animation made by swift doesn't have problems because there's no actionscript or movie clips involved.. so you can edit it.
but I'd use swft format if you have swift 3d v3.

See according to the consulate, they say the following
passport or travel document valid for at least three months after visa expiry date
In this case, they mean the schengen visa expiration date. For example, if I am travelling from April 1 to April 20th, they will give me visa only upto April 20th. They want my AP to have expiration atleast 3 months from April 20th (which will be July 20th) but my AP is expiring on April 10th.

Hi All,
I sent h1b extension application to california center on june 22nd and my application is still not approved. My current visa was valid until July 30th. I need to travel to India on Dec 10th due to urgent reasons . Please suggest what should I do
1. Can I travel while my extension is pending?
2. Can I raise a service request to speed up the processing?
2. or Upgrading to PP is the only option?
I do have EAD and advance parole through my husband's GC application. If I use parole for travel what happens to my H1b visa and GC application filed through my employer. My visa will still be valid or not?
Please help...

I already applied 485 with one I40 Priority date.
If I get my another labor approved with a old Priority date, can I amend my existing 485 with this new PD or should I be applying new 485 ?

You can get -
1. a year extension to recapture the time spent abroad
2. New/Extend H-1B for 3 year, but will be subject to cap
3. can get new/extension H-1B for 3 years without cap, if you have I-140 approved
4. can get new/extension H-1B for 1 year without cap, if I-140 is pending

The reason I was asking is because recently this application to consider this as a new H1b for 3 years was rejected and instead only one year (recapture time for year abroad) was issued.

I am currently on 9th year H1-B and my H1-B expires May 2008. I filed my I-140/I-485 in August and have received the receipt notices. My EAD got approved too.
Can I file for a 1 year H1-B extension based on a pending I-140 even though the I-140 is pending for less than 365 days ?

I am currently on EAD from 485 application (no H1b)..My 485 is applied in eb3 category. Also i-140 is approved.. I have moved to a new position in the same compnay where the job duties are 50% different from the earlier position.The Position also entitles me to start another Green card application under EB2. My QUestion is
Is it possible to apply for another GC in Eb2 and use the EAd status from the Eb3 application? Since I do not have
an h1b my only valid status in US is EAD and 485 from the Eb3 application

I was working for company A and got my labor and I-140 approved and then i changed to company B. My priority date is jan 2005. Is there any way that i can continue my green card process with company A. WOuld be of great help if somone can tell me if there is any way to do it.
I think that as far as company A agrees, it shouldn't be a problem. I believe the GC application is for a future job offer.

Is the Service Center processing I 485 applications around the RD of your 485 application?
I don't know how to check that , because when I click on the checking by the RD of the file in the service center , it doesn't show any I-485 on the list !...

Hi,
I just found out that my employer did not update the work location on my LCA. I have been working in new jersey for over 4 years now. I have my primary address as Indiana and my company is registered in Illinois. I got payroll on Illinois for 2 years and now NJ for 1 year.
How can i correct this? Is it too bad a problem already?

My NIW/I-140 application has been pending for a year. During this time, I have more qualifications added to my resume. Is there a mechanism to send my updated resume or should I just let it be?

They asked me to send additional evidence in support of my NIW petition. I'd say just wait for them to ask you anything that they require to justify NIW.

H1, H4 (spouse) and H4 (kid) living happily.
File 485 and gets EAD/AP.
H1 doesn't use EAD.
H4 uses EAD and hence looses H4 status.
I-485 is denied.
Now, my understanding is that spouse has to go out of country and come back again on H4.
What about the kid?
When does the kid loose his/her H4 status? (When both mother and father use EAD)?
