Folks,
I would like to run a questions by you guys/gals. I am getting ready to file my I-485 application. My lawyer requested that I find all copies of my I-20, OPT EAD, H1-B's etc. My question is do we have to submit copies of I-20, and OPT EAD for the Adjustment of status (I-485) stage ? Please let me know what you think ?
I-20 is from a university that accept students in the US. The F1 student visa is issued based on the I-20.

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.
That USCIS director gave a good answer. Is your pain more than those citizens of this country who gave their limbs and life for US?. :eek:

The British made us feel in the hey days that living in our own country was a previlege extended by their administration...even in that environment...Gandhigiri worked....but not without several initial failures..and Gandhi himself had acknowledge that non-violent resistence can succeed even against hitler but not without several initial failures...
The fact that we could get Mr. Gonzalez to even respond to the flower campaign itself speaks that Gandhigiri has worked...the publicity that this will generate will be of immense help....

yes, that is our line of logic and understanding. But seeing the number of experiences what we are having in real world, this does not seem to be applying. You are rightaway asked about your work status and they insist till you give them "specific" word - either "GC" or "Citizenship" or "EAD"... If this would have been the real way ( I and all of us wishes that) the these recruiting guys may not dare to insist till you spit the speific word out and that is before interviewing. In my experience, I always had verbal conversation. I have never been sent an email or letter by any company yet regarding their refusal not to even interview me based on EAD. Verbally 5 companies have starightaway told me "they are not considering me as I do not have green card yet - EAD is not enough". My thinking is that they do this because somehow some law may be covering them, we do not know that but they know that, perhaps..:confused:

Having said that, I do understand that the employer can find a number of reasons to not hire somebody and all that would be legal. But here we have a case where you have 5 companies who have refused to consider you solely based on your immigration status. Somebody earlier has this in writing from Capital One.
I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.

Yes. No one has bothered to go after DOS for misinterpretting the AC21 rule in allocating immigrant visa. Many people (EB2-India) raised their concern between 2003 and 2006, as DOS is not correctly following the rule and allowed the spillover to go EB3, when EB2 was in high demand particulrly from India. Even IV core did not go after DOS. As you mentioned, lawyers has no incentives. EB3 has enjoed between 2000 to 2006 (from the mercy of DOS). For example in 2006, EB2 got about 25,000 visas abot 20,000 visas (from EB2)has gone to EB3-ROW.
IV from my interpretation is about ending retrogression and increasing total visa numbers and not about reallocation of visas and spending resources on a zero sum game. This issue should have been taken up by affected individuals. I'm sure they did it though because DOS has awakened to the fact that they were not following the law.

Five of the top six employers of H1-B visa workers in 2006 were Indian companies. They were issued 18,453 visas. In total, almost 20,000 visas issued in 2006 went to Indian outsourcing companies, and the data shows it was not American workers who benefited but foreign workers.
JOHN MIANO, ATTORNEY: According to the Bureau of Labor Statistics, between 2000 and 2005, the United States' employment for computer workers grew by about 332,000.
During the same time period, the United States imported about 330,000 H1-B workers for computer occupations.
TUCKER: The situation for engineers was even worse, with 95,000 H1-B visas issued in the same period for engineering, yet according to the Department of Labor, engineering jobs shrank by almost 124,000 jobs.
The visa is often referred to as being for the brightest and the best. But, the visa is broken up into four levels of classifications, with levels 1 and 2 being the lowest-skilled positions, and 87 percent of the visas went to those categories. WTF is he talking about 1 and 2? how can bachelors required masters required be lowest skilled positions?
RON HIRA, ROCHESTER INSTITUTE OF TECHNOLOGY: We really don't know whether those workers are working at level one. We know that they're being paid level one wages.
And what's interesting, at level one is if you look at the description of it, it's basically for interns, for people who have zero experience. From what I know H1 cannot be granted with Zero experience Am i missing something????

I understand it must be hard for somebody in your situation. But anecdotal evidence and statistics suggest that however hard life is for immigrants in the United States, it's even harder for immigrants in Europe.

Hi All, I had a quick question.
My I-485 got approved earlier this week from NSC and I received the approval/welcome letter by USPS.
My online status is at post-decision activity and not at CPO.
Though my welcome notice says that I should receive the card in 3 weeks, I am wondering if I need to be at CPO status before that happens....also I read somewhere they may require another FP before CPO (that was talking more abt transfer cases, but mine has always been at NSC).....but nowhere in my approval notice does it ask for an FP.
I was wondering if I should just sit tight and wait for the physical card or try to find out more information.

Any idea when the new proposals will be implemented if they become law :confused: Do we have to wait until Oct for these new proposals to take effect.

Good question. The bill is expected to be on the floor of the Senate and House for debate in Feb-06. Learning from S1932, it is my guess that the soonest bill could be law is 2-3 months. So we may be looking at something like April/May-06. But nothing is for sure at this time. It is possible that the debate may be dragged on till third quarter of 2006. We should start the activity to communicate with the law makers right now and continue to convey the right message if we want anything good to come out of the new bill.

Like 140 premium that program will be first suspended and then dumped eventually because there are resource and Process problems internally.
Unless you fix root causes - these Premium things ain't going to work.
IV should propose a Premium Processing for FBI Namecheck/ Other Background checks. For certain extra fee UCIS/ FBI can do this on premium bases.

Unless we have some options, that comes from Congress that will assist in recapturing the unused visa number, filing I-485 when visa numbers are not available, this is a never ending problem. To get this done, we have to strengthen the lobbying efforts. This can be done only if there are enough funds... It depends on how much folks are willing to contribute. Each individual has to make their own decision what they want.

Do you know if WOM can be filed only when the PD is current. After reading this article i feel so.
PD has no effect on filing a civil action as visa bulleting is changing every month. My friend in Oregon got I-485 approval after filing Wom even though his PD is not current on the latest visa bulletin.
