Hi, Did you send the AC21 letter yourself? Can you please let us know the format of the letter and supporting documents you sent? Also, please share the format of G-28 explanation. How was your experience so far? Did you receive any confirmation back from USCIS? Thanks.
meimmi, we are still working on it.
might end up hiring a lawyer only for filling AC-21. I know its not a big deal, but still trying to be on the cautious side.
We also had the same questions as u had and were not able to find anything.
If you find anything please share it with us also. We are going to file this week for sure.

The actual backlog at beginning of 2010 is 200K (pending I-485) + all EB2 I/C and EB3 waiting to file I-485 from 2007-2010. The no of folks in EB2I/C and EB3 ROW from 2007-2010 will be about 80-100K. So instead of 2-3 years , overflow will start reaching EB3 in ~ 5 years.
Yes @the beginning of 2010 - 200 K . Now ~@160 K. The flood gates will not open at least for another year. Just like 2009-210, 2010-11 will see significant reduction in backlog , so next year at this time we may be @120 range. That's when it is very close to EB3-I.
Now problem with your analysis is you assume that USCIS will open the flood gates and make EB2-I current letting in all the applications from 2007 -2010 in one shot. That is questionable, especially since they got burnt in 2007 . They will gradually open the gates . And 70-80 K EB2 and EB3-ROW applications between 2007 -2010 sounds little high.
So I do think we will start burning the Eb3-I backlog with 2-3 years, by 5 years all categories will be current.
And one thing that has not got enough press here is , how the EB3-ROW has got significant overflow in the last two months though EB2- I/C are no where near current. Per common understanding , they should not get a single overflow till EB2 is current .
Street Justice ??

I have 2 European co-workers. They both told me, "The only way we will go back to Europe is when we die".
Which European countries are they from? Their opinion can be relevant in this context if they are from a rich EU country, but less convincing if they are from Albania, for example.

The visa numbers reported as used for FY 2009 is 141,020 from http://www.travel.state.gov/pdf/FY09...ort_TableV.pdf
This was the response i got from Ron Gotcher.
"The employment based category is entitled to use the "unused" family based numbers from the previous year. Last year, the quota for EB was the base of 140,000, plus another 13,000 shifted over from FB. Unfortunately, the CIS failed once again to approve enough cases to use up the entire available quota."
.....
Would you mind asking source/link for "another 13,000 shifted over"?
As per this link - family based numbers were totally used up for FY2008
http://www.travel.state.gov/pdf/FY08-AR-TableV.pdf
Family based visa used for FY2008 = 226,105 against 226,000 available.
I think it is important to understand and read what is being said.
I suggest that you follow your own advice and read & understand what is being posted in this thread. What do you think? Is this information or "message" correct?

The only thing I liked is at the end that says
"Makes permanent an INA provision allowing adjustment of status of certain aliens for whom family-sponsored or employment-based applications or petitions were filed by a specified date".
But that doesnt mean we start dreaming again.. Lets put our efforts. I got an email from Obama today (and I am sure may have also go who have previously posted their stories on his site) that he wants to hear from us what we think about the currrent issues.
Did you post your story and the problems we are facing?.
Lets keep writing non-stop. We just need an admin fix, not the whole CIR.

you write some ridiculous stuff in your first post and you want us to chill out. Get a sense of this board and its professional members, before you post any nonsense like that.
As I said previously, just chill out.Let me give all you guys some advice whether you want it or not.You guys are just busy speculating about something which you guys have no idea about. As a result all you guys are doing is getting worked up and trust me this nonsense is not helping you one bit.
If you are giving some factual help with how to file, procedures etc it is one thing, baseless speculation will get you nowhere. If you think I am not in the same boat as the majority of you-- you are mistaken. It is just that I try to stay positive while you guys keep whining. We all know the system is not working fairly for Indians even though we are bright, intelligent and law abiding folks.
You have no idea how dates will progress,so to reiterate once again just chill!

Apparently, the police officer told you the exact story: by law you should carry all your immigration documents, but in practice a passport is good enough. By law he could deport, but in practice he won't though he had enough opportunities.
Well, this is NOT a cooked up story. This happened to me yesterday at Harlingen (HRL) Texas airport.
On January 16, 2008, I went to Mexico for H1-B visa stamping at Matamoras US consulate. I got my H1-B visa stamped and returned to Brownville, Texas.
On January 17, 2008, I was at Harlingen (HRL), Texas airport for my final destination.
One of the TSA security personnels is in process of verifying my ticket before proceeding to security check. As every one knows, we must present one of the government issued PHOTO-ID to them to clear the security check. I have shown my driver license and he has cleared the security check (name check).
I was about to proceed further for security screening; mean while, a Police Officer came to me and asked me following questions.
Sir, are you a US citizen?
I said, No
Then, he asked me, can I see your immigration documents.
I have shown my passport to the police officer.
He looked at H1-B visa and I-94 and asked me; who do you work for?
I said my employers name.
Later, he gave me my passport back.
Now,
I have asked the Police Officer few questions
1. Sir, Im in domestic traveling, is it mandatory to carry my immigration documents at all times?
Police Officer said, as per the US LAW, all non-immigrants must carry immigration documents and passport at all times.
2. What would you have done to me, if I had failed to present my passport?
Police office said, I could have DEPORTED you.
3. Sir, it is not possible for any one to carry passport at all times. Could the LAW allow me to carry photo copies of my passport and immigrations documents?
Police office said, No. Technically, you must carry original documents at all times.
I would advice you to carry Passport at all times.
I did not know this until Police Officer told me about this LAW.
P.S: BTW, the Department of Homeland Security (DHS) level is in ORGANE.

The spirit of US is to united everyone from different countries and races to live together to be loyal to the same country. But truly they don't want too many immigrants from one or two specific country. That is why they setup the country limit rules. So the population for all the immigrants from differnet places grows up about equally in this country. I think this is normal to every country. I believe every country will do the same if they are facing a lot immigrants. If the other day many immigrants from other countries want to go India, Indian gov. will do the same.
Just to be curious, where is the fight the OP mentioned. Can OP link us or is it just OP think there is a fight?
I agree with your point that US wants to bring people from over the world and not just few countries. The removal of Country quota WILL NEVER happen. May be they will atleast slightly increase the quota for oversubscribed countries.

I have worked in France and Belgium for a little over an year and this is my personal experience - the work environment at that time 2000 - 01 was alright. However, I had to struggle with language barriers and worse of all - the keyboard barriers. The standards in IT industry were very very different and though it was an experience, the learning curve was huge. Personally, I would much rather prefer to be in US or better still in UAE I'd think.
Next, I have been reading a lot about reverse brain drain - where families were going back home. I also heard about some site about return2India.com. And my brother took the step after pondering over it for an year - he had it all - GC, a family here, job at you know where in Seattle - and his experience has been an enlightment - he is now struggling with work life ratio - he spends most of the day/night at work and he has to pay bills at the bank and he has no clue what is going on at the school and somehow, his team in India thinks he is a smartass because he tries to apply certain standards (which ofcourse is normal here) and he speaks with an accent. And yes, if you studied here and lived for 10 years, you too will have the accent. But, he says he is very satisfied and happy to be there. And then he says, the pay scale is sufficient for him and his family to lead the Indian dream. We should have some way of commuicating with such expatriates too!!!

what is the percentage you are looking ? 50 -50 ?I know thousands of people who can write a check for 10K to support any law that can give them a GC in the next 3-6 months..
Here is the thing: We all can write 10K checks to get a GC in next 3-6 months but things don't work that way...small persistent steps lead to assured success...see if you can get the people you know sign up for a 6 USD per week recurring donation, it takes 5 minutes of their time.
This is like having one subway sandwich per week for 6 months, the key is to do it persistently every week/month. Thanks!
