    I agree...

    No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.
    Don't come after me for saying this, its not my opinion. But general opinion that I have observed from people who are not well informed(read majority of people). Lets focus on the main stream media in US, outside coverage is not that significant anyway.

    Right, but that A# I found on my H1b approval (approved Oct 10 '07) is different from the A # in my 458 receipts.

    Just trying to figure out if folks who had an A# in the H1b approval notice are also facing the PIMS delay. (just a wild guess).

    I had both a valid visa stamped on my passport and AP. But my wife did not have a stamped visa so I showed her AP and my h1. The immigration inspector said that you both have to use AP to enter. I argued with him a little that I can use my h1 when it is valid but he did not agree and said that I am trying to do a fraud. Well I did not argue much and let him stamp my I 94 with a parole stamp till 01/26/2007. I have now filed for my extension.

    -interviewed on 28th Dec
    -officer said that I will have to wait at least 48 working hours for an approval email and on receiving email should submit the envelopes given by them, copy of I-797, copy of approval email.
    -havent received any email as of today - 5th Jan 2008.
    - Does anybody know if I will face further delays since mine is an Adj of Status case ?
    - wish I had got my AP before I travelled, unfortunately had to come due to some urgency..

    Anyone has templeate of letter to fax or e-mail?

    I do not show that we have data-entered Mr. XXX�s I-485 yet. The I-485 must be in line to be data-entered because we receipted an I-765 (LIN-07-245-XXXX).

    The I485 application is still pending at this office. Although the Department of State Visa Bulletin indicated visas were available for most employment categories USCIS still has to adjudicate every application. NSC has approximately 26,000 I485 applications that may have a visa available and we are reviewing them as expeditiously as possible. This application is in line to be worked but it will take time. Please allow an additional 45 days for NSC to adjudicate the application. If you have not received a notice from NSC after 45 days you may submit another inquiry.

    Sub: USCIS inefficiency for Legal Immigration


    I send my I-485 AOS application to USCIS and received on July 2nd 2007 at Nebraska Service Center, Lincoln, NE.

    It's almost approx 75 days since the application received at USCIS and have not received the Receipt Notice or any notification from USCIS.

    I tried to contact Customer Service at USCIS. They don't provided any information. USCIS website updates show they are processing 08/01 or later for AOS application. They are not following the First In First Out(FIFO) order.

    I need help of your good to know the status of my I-485 application.

    We know EB2 - I dates have not moved since Oct ,2010 .
    So India regular quota for the last six months : 5800/2 = 1900 .

    Since dates have not moved, I am assuming 1900 should also be considered towards porting.

    so my conclusion is so far 1200 + 1900 = 3100 porting already took place. (though only 1900 really got GC)

    I think you meant to say 2800 not 5800. I'm correcting your statement.

    Is that mean they are going to move the PDs much further and again move back during the end of the year!!

    So isn't this implying that the PDs will advance very very further than the available visa numbers!!!!!!!!!!

In preparation of the May 2011 Visa Bulletin, DOS will consider the approximately 12,000 unused EB-1 numbers that will "spill-down" to EB-2, EB-2 demand and possible unused numbers, and will consult with USCIS on its processing potential. A quick look by DOS at this point indicates that there is the possibility for greater advancement of the India EB-2 category than had earlier been thought. Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

    My comments earliar this morning.

    I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.

    They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

    8) Service Request Yes/No --> Yes (opened SR on 09/02/10 citing "outside processing
    time" and no updates on the case after initial filing)
    9.) Contact Senator Yes/No --> NO
    10.) Recent RFE Yes/No --> EVL in 2009
    11.) AC-21 (Employer change) NO
    12.)Ported Case(EB3->EB2) Yes/No --> NO

    Thanks to all the great folks at IV that helped me navigate through this journey. This has been a great forum to know the updates and issues faced by the Highly Skilled Immigrants like us...
    It has also helped me in understanding the situation from the inception of my journey and helped me make my moves accordingly with one goal of getting GC without going through any hassles.

    And finally , I sincerely pray for all the folks in EB-3 to get some kind of relief soon, so you can get greened soon. And I would still support this great organization in what ever way I could.

    Been here since 1998. Filed labor in 01 but was revoked due to tech downturn. Filed again in 05. Fortunately my GC was approved last Aug.

    I think the final goal for most folks is citizenship.. including some of those who dont want to stay here permanently. Waiting 15 - 20 years for citizenship makes no sense.. if they are thinking of giving it to illegals in 10 years, whats wrong in asking?

    Yes you can -when you were eligible for the EB2 filing at the time of filing for EB3!

    Why would someone do that u ask? Please call my employer and ask him this question. The answer is - so that you are stuck with him for few more years.

    I am in the same boat. My employer decided to file my case under EB3. For that, even the job position was in such a way that required only EB3. I had 7 years experience at that time. So it could have been EB2. That is fine, I am not sad about it.

    My question is, since the original position had requirements that met EB3 and not EB2, how can you now justify moving to EB2 within the same company and for the same position?

    Let the flowers go to USCIS and let them do whatever they want with the flowers. Kindly dont jinx this campaign by cancelling your orders and asking for refunds.

    It's too late flowers have shipped. They will have to be delivered somewhere, it'll just force the fedex/dhl not to accept a forward from USCIS.
