I applied under EB2-NIW on July 28, 2007. Under the concurrent filing allowed at that time, I submitted NIW, I-140, I485, and EAD applications for me and my wife. I have changed jobs, and joined a new company last week.
Since I filed a self-petition, my application should not be directly affected by this move. However what do I need to do to inform uscis about this change, so that my receipts/EAD etc. do not go to the wrong place, or worse, get returned by the post office.
Please advice. Any additional info/experience would be great.

I have not heard of a single approval date of someone applying on June 1st!
According to the processing dates, they are all in RD of 06 sometime.
People HAVE been getting receipt numbers, but thats an entirely different kettle of fish.

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....

I recently found a new job and they filed for my H1 transfer in premium processing. I am still working for my old employer. Now I have got an RFE questioning why my salary (in 2009 W2) which is less than what was mentioned in my previous petition. Even though I have all my paystubs I was on bench for few months between march - may 2009. I have a leave letter for 4 weeks vacation in may and my salary was reduced when I got new project. Which explains why it is less but may not be enough to prove it to USCIS. Salary in W2 could also be less that prevailing wage. Right now I have following scenarios
1. WIthdraw application - not sure repurcussion of this.
2. Respond to RFE with mentioned reason which can have following outcomes
a) Appoved - (good i will be more than happy)
b) Approved with consular processing - (I dont want to travel at this point of time outside US)
c) denied - (not sure)
3. This case goes to DOL and there may be investigation or indent of revoke sent to my employer. Can this happen?
Here are my questions
1. Senario 2.b. If I get "Approved with consular processing" do I have to travel to India for stamping immediately or just get new I94? What will be my current status then? What if I decide not to join the new employer?
2. Senario 2.c. If I get "Denied" what will be my current status?
3. What should I do so that I am not out of status and I dont have to travel to India for stamping?
4. Scenario 3, Can this happen?
Any response will be appreciated. Thanks!

Thank you for the response. I guess one more follow up question. Since I already have an H1B stamping (visa) in my passport that is valid until September 2011 (which lists Company A as my employer). If Company B were to successfully apply for a transfer from B2 to H1B, if I travelled outside the USA, could I still return to the USA with my old H1B stamping in my passport or would I have to go to a US Consulate and get another H1B stamp (visa) that lists my new company?

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

There is an error in the article.
It does not say that H1B workers lack any courage and will power to stand up for themselves. They lack unity, are narrow minded and cannot work together. Their high education works in their disadvantage because they use to fight within themselves. As long as they cannot stand up and support their own cause, it is good news for anti-immigrant organizations.

YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

I am on H1B in USA and am an Indian citizen. I have been divorced and about to get remarried. My would be has a natural born kid of from her previous marriage before her husband expired. I will marry her legally per Hindu custom and then complete the registration after that. I will adopt her kid also as per proper procedure.
This is NOT like regular adoption. Usually when a couple can't have any kid of their own, they adopt someone. Or despite having a kid they adopt another kid etc. In these cases getting an H4 is very tough, or so I heard.
Shall I be able to get an H4 for this biological kid of my would be spouse? Again, she is a biological kid of her.

- 2 Photos (A# and Name on back side with pencil)
- Check ($305) to U.S. Department of Homeland Security

One is Employer Job title which is "Analyst Programmer" other one is prevailing wages occupational title which is "Computer Systems Analyst". My question is what should be my Title at new employer?

I used last time and I show offcer only one and he return it to me.

Hi..I was in a similar situation. Best thing for you to do is File for F2. Make sure you send dependent I-20 issued from your wife's school with your F2 application. Pay slips are only needed for changing status from H1 to F2, in your situation. No payslips are needed when you change status back to H1, because you are on F2 at that time. hope this helps.good luck.
